Making Your Move ContestOfficial Rules HENKEL CORPORATION NO PURCHASE NECESSARY. MUST BE A LEGAL U.S. OR CANADIAN RESIDENT, 14 YEARS OF AGE OR OLDER. VOID IN PUERTO RICO, THE PROVINCE OF QUEBEC AND WHERE PROHIBITED BY LAW. TIMING. The Henkel Corporation “Moving Made Easy Contest” (“Contest”) begins at 12:01:00 a.m. Eastern Time (“ET”) on May 1, 2008, and ends at 11:59:59 p.m. ET, on September 30, 2008 (“Contest Entry Period”). Entries must be submitted by the end of the Contest Entry Period to be considered. Entries postmarked or e-mailed after September 30, 2008, will not be considered. SPONSOR. The Contest is sponsored by Henkel Corporation, 32150 Just Imagine Drive, Avon, Ohio 44011-1355 (“Sponsor”). ELIGIBILITY. The Contest is open to legal residents of the United States and Canada, including the District of Columbia, but excluding Puerto Rico and the Province of Quebec, 14 years of age or older at the time of entry who submit a valid Contest Entry as defined in the Official Rules (“Entrant”). Employees of Sponsor, their family members, and persons living in the same household as employees or their family members are NOT eligible. All federal, state and local laws apply. ORIGINAL WORK/NO INFRINGEMENT. By entering the Contest, Entrant states that the Contest Entry is an original, true, factual, non-defamatory work, has not been previously published, including previously submitted in this contest, or won any award, and that Entrant is aware of no conflicting rights in the Contest Entry including but not limited to copyright or other intellectual property right. Entrant represents, states and agrees that his or her Contest Entry will not infringe upon the intellectual property rights of any third party, including by way of example and not by limitation, any copyright, trademark or patent rights belonging to any third party. PUBLICITY/USE OF NAME AND LIKENESS. Except where prohibited by law, entry in the Contest constitutes each Entrant’s consent for Sponsor to use Entrant’s name, city and state of residence, entry, likeness, photograph, image and Contest Entry for advertising, publicity, and promotional purposes in any media, online or offline, without further permission, consent, payment or other consideration, unless prohibited by law. HOW TO ENTER. Entry may be made on-line or by U.S. mail. For on-line entries, each Entrant must go to www.makingyourmove.com, click on “Moving Made Easy Contest” and submit: (1) One (1) original story no more than 250 words in length about “a helpful suggestion for making the moving process faster, easier or less stressful”; (2) Entrant’s first name, last name, address, phone number, email address, and age (collectively, “Contest Entry” or “Contest Entries”). Entry by U.S. Mail: Submissions of the above information should be sent to: Moving Made Easy Contest, 32150 Just Imagine Drive, Avon, OH 44011-1355. Limit one submission per individual. Sponsor reserves the right in its sole discretion to disqualify any entry that Sponsor reasonably believes contains profanity or other offensive depictions, or that in any way may defame or jeopardize the good will or reputation of Sponsor or any third party. CONTEST ENTRIES. Contest Entries become the sole property of Sponsor and none will be returned. By participating in the Contest, Entrant grants to Sponsor the non-exclusive, irrevocable worldwide right to use, publish and copy the Contest Entry in any media, in whole or in part, without geographical limitation or compensation to Entrant, including by way of example and not by limitation, display at the Making Your Move website, located at www.makingyourmove.com. JUDGING CRITERIA/NOTIFICATION OF WINNERS. Winners will be selected from among all eligible Contest Entries based on a composite score using the following criteria (“Judging Criteria”):
Sponsor will score all eligible Contest Entries based on the Judging Criteria and will select the Winner on or about 12:00:00 p.m. ET October 10, 2008, at Henkel Corporation, 32150 Just Imagine Drive, Avon, Ohio, USA. In the event of a tie score between two or more Entrants, the Contest Entry that has the highest score in the category of the Helpfulness/Time savings will be selected as the Winner. Sponsor will notify the winner via phone in accordance with the information provided by Entrant in the Contest Entry. It is Entrant’s responsibility to ensure Sponsor has the correct phone number to notify Entrant of potential selection as a winner. In the event that Entrant’s phone number changes during the Contest Period, it is Entrant’s responsibility to notify Sponsor of such change. Winners, or where the Winners are minors, the Parent or Guardian who signed the original Release, must sign and return an Affidavit of Eligibility and a Publicity/Liability Release (except where prohibited by law) via pre-paid overnight courier within Seven (7) days of receipt of those documents or prize may be forfeited. In the event that any prize notification is undeliverable, Sponsor is unable to contact a Winner, or response to a prize notification is not received within Seven (7) days of its issuance, the prize may be forfeited. Where a prize is forfeited, the Entrant with the next highest score in accordance with the Judging Criteria will be chosen as an alternate winner. Winners will be announced via news release and posted on the www.makingyourmove.com Web site on or about October 20, 2008. PRIZES. There will be Three (3) Winners: One (1) First Place Prize, One (1) Second Place Prize and One (1) Third Place Prize selected from among all eligible Contest Entries (collectively, “Prize(s)”). First Prize: The First Place winner will receive a cash prize of $2,500.00. Second Prize: The Second Place winner will receive a cash prize of $1,500.00. Third Prize: The Third Place winner will receive a cash prize of $750.00. The total value of all prizes is $4,750.00. All prizes will be awarded. Where winner is a minor, prize will be awarded in the name of the parent or guardian that signed the original written parental Release. No substitution or transfer of prizes is permitted. All taxes are the sole responsibility of the prize winners. Sponsor will issue a 1099 form to winners (or their parent or guardian) receiving a prize. TERMS AND CONDITIONS. Participation in the Contest constitutes Entrant’s full and unconditional agreement to and acceptance of these Official Rules. Sponsor reserves the right in its sole discretion to disqualify any entrant it finds to be tampering with the operation of the Contest or to be acting in violation with these Official Rules. Entrants agree that Sponsor, its affiliates, parents, subsidiaries, agents or contractors and their employees, officers and directors shall not be liable for injury, loss or damage of any kind resulting from participating in this Contest. Because this is a contest of skill, odds of winning depend upon the eligible Contest Entries received and Entrants’ final score, as determined by the Judging Criteria for the Contest. Winning is contingent upon fulfilling all requirements of these Official Rules and Sponsor’s decisions as to the administration of the Contest and prize awards are final. Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Contest should fraud, technical failures, or any other factor beyond the reasonable control of Sponsor impair the integrity of the Contest, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award prizes based on the Judging Criteria from the eligible Contest Entries received up to the time of impairment. BY RECEIPT OF ANY PRIZE, WINNER ACCEPTS THE PRIZE WITH NO FURTHER OBLIGATION FROM SPONSOR OR ITS AFFILIATES, AND AGREES TO RELEASE AND HOLD HARMLESS SPONSOR, ITS AFFILIATES, PARENTS, SUBSIDIARIES, AGENTS OR CONTRACTORS AND THEIR EMPLOYEES, OFFICERS AND DIRECTORS (“RELEASED PARTIES”) FROM AND AGAINST ANY AND ALL CLAIMS OR CAUSES OF ACTION RELATING TO OR ARISING OUT OF ENTRY IN THE CONTEST OR RECEIPT OR POSSESSION, USE OR MISUSE OF ANY PRIZE OR ELEMENT THEREOF. Sponsor, its respective affiliates, parents, subsidiaries, agents and employees are not responsible for late, lost, illegible, incomplete, stolen, misdirected, illegitimate, or impermissible submissions or mail; postage due mail; or any other error whether human, mechanical or electronic. Proof of sending or submitting a Contest Entry will not be deemed to be proof of receipt by Sponsor. PRIZE WINNERS AND OFFICIAL RULES. Contest results will be available within 20 days after the close of a Contest Period. Requests must indicate the specific Contest Period requested, and must be received within 90 days from the end of that specific Contest Period.   |
